These Terms of Use were last updated on 4 September 2019.
CITYVISION offers tourism services — in particular excursions, tours, sightseeing,
leisure activities and gastronomic or cultural discovery — either directly or through
its affiliated websites (hereinafter the "Services").
Legal notice
The website www.tourism.paris (hereinafter the "Site") is published by CITYVISION,
a simplified joint-stock company (SAS) with share capital of EUR 6,072,000, whose
registered office is at 194 rue de Rivoli, 75001 Paris, registered with the Paris Trade
and Companies Register under number 421 197 005 (hereinafter the "Company").
Its intra-Community VAT number is FR60421197005.

The publication director is Karl GREMILLET.
The Site is hosted by OVH SAS, a French simplified joint-stock company (SAS) with share capital of EUR 50,000,000, registered with the Lille Métropole Trade and Companies Register under number 424 761 419, whose registered office is located at 2 rue Kellermann, 59100 Roubaix, France.
The Company is registered with Atout France under number IM075120024.
The Company holds a financial guarantee with APST, 15 avenue Carnot, 75017 Paris.
The Company has taken out general civil liability insurance with MMA IARD,
14 boulevard Marie et Alexandre Oyon, 72030 Le Mans Cedex.
Acceptance of the Terms of Use
The purpose of this document is to define the terms and conditions (hereinafter the
"Terms of Use") under which the Company makes the Site available to users (hereinafter
the "Users") for browsing and use.
Use of the Site implies full and unreserved acceptance of these Terms of Use.
The Company reserves the right to amend these Terms of Use at any time and to inform
Users by any means. Such amendments take effect as soon as they are published on the
Site. Users are invited to keep themselves informed of any such amendments. Users who
do not accept these amendments are invited not to use the Site.
Use of the Site
Before using the Site, Users must ensure that they have the technical and computing
means required to browse and use it. They must also ensure that the configuration of
their equipment is in good working order and free of viruses.
The Site may only be used by persons aged eighteen or over. Any person under
the age of eighteen wishing to use the Site must obtain the express consent of their
legal representative.
The Company reserves the right to modify, revise, delete, validate or change, in
whole or in part, any content (the "Content") appearing on or displayed by the Site.
The Company may delete, change or modify the Site and/or the Content at any time and
without notice.
User obligations
By using the Site, Users agree:
- to refrain from using the Site unlawfully, for any unlawful purpose, or in any manner incompatible with these Terms of Use;
- not to use the Site to publish content that is insulting, defamatory, harassing, slanderous, obscene, pornographic or threatening, and/or that infringes the privacy of others;
- not to sell, copy, reproduce, rent, lend, distribute, transfer or sub-license all or part of the items, information and Content appearing on the Site, nor to allow
any third party to use or access the Site for any purpose whatsoever, nor to
decompile, reverse-engineer, disassemble, modify or display in human-readable
form, attempt to discover any source code, or use any software that enables or comprises any part of the Site; - to respect other Users;
- not to collect or store personal data relating to other Users, for any purpose;
- not to distribute content that may constitute incitement to commit crimes or
offences, incitement to discrimination or racial hatred, or more generally content
contrary to applicable laws and regulations, to these Terms of Use, to public
decency or to public order; - not to distribute information of an ideological, religious, political or
ethnic-claim nature; - not to distribute content liable to endanger minors, in particular the
distribution of violent or pornographic messages; - not to attempt to mislead other Users by usurping the name or pseudonym of another
person; - not to display, transmit by email or otherwise any item infringing any patent,
registered trade mark, trade secret, intellectual property right or any other
proprietary right belonging to others; - not to display, transmit by email or otherwise any unsolicited or unauthorised
advertising or promotional material (in particular spam, or any other form of
solicitation); - not to use the Site improperly by deliberately introducing viruses or any other
malicious program, nor to attempt to gain unauthorised access to the Site; - not to disparage the Site, the Company or other Users on social networks or by any
other means of communication.
If, for any reason, the Company considers that a User is not complying with these
Terms of Use, it may at any time and at its sole discretion withdraw that User's access
to the Site and take any measures, including legal action, against them.
Accuracy and lawfulness of information
Each User undertakes that all information they provide, in particular information
concerning themselves, is adequate, accurate, up to date and complete. To that end, they
undertake to update it regularly.
Users acknowledge that the Company does not have the material means to verify the
truthfulness of all information appearing on the Site. The Company may not therefore be
held liable in the event of identity theft, or where the information given is false or
misleading.
Nor does the Company guarantee the appropriateness, lawfulness, integrity or quality
of information transmitted by Users.
The Company may under no circumstances be held liable for content communicated and
posted by Users, in particular its unlawfulness under applicable regulations, any error
or omission, or any loss or damage resulting from its use or transmission through the
internal messaging system or otherwise via the Site.
Personal data
Provisions concerning the protection of personal data, as set out in the French Data
Protection Act of 6 January 1978 as amended and in the European General Data Protection
Regulation of 27 April 2016, which came into force on 25 May 2018 ("GDPR"), are set out
in a separate document entitled "Privacy Policy", available on the Site.
Intellectual property
By accessing the Site, Users expressly acknowledge that the Site and the Content
created by the Company and made available to Users are the exclusive property of the
Company and are protected by the French Intellectual Property Code as well as by
applicable international treaties and agreements on the protection of intellectual
property rights. Accordingly, they may not be reproduced without the express
authorisation of the Company, on pain of civil and criminal proceedings.
The Company is the sole holder of all rights, title and interest in the Site and the
Content, including all intellectual property rights and in particular all rights
relating to copyright, design rights, trade marks, signs, trade names, corporate names,
domain names, technology, know-how, processes, formulas, source and executable code,
data and similar rights, including information relating to any application, registration
or renewal thereof which may be protected by the intellectual property laws, regulations
or rules of any country.
The Company grants Users a non-exclusive licence to use the Site and the Content
strictly within the framework of these Terms of Use.
Any reproduction, representation, adaptation, exploitation, distribution,
dissemination, commercial use, translation, arrangement, transformation, or the creation
of any derivative or composite work from all or part of the works and/or any other
Content appearing on the Site, on any medium and by any process whatsoever, whether
current or future, is expressly prohibited. Such acts may constitute infringement,
punishable under criminal and civil law, and engage the liability of their author.
The systematic and repeated extraction of the information and Content appearing on
the Site is strictly prohibited and sanctioned under intellectual property law and under
the sui generis database right. Any unlawful extraction may engage the civil and
criminal liability of its author.
"CITYVISION" and all other trade marks and logos of the Company are trade marks
protected by French intellectual property law (hereinafter collectively the "Trade
Marks"). Save with the written and express authorisation of the Company, Users undertake
not to use or distribute the Trade Marks in any manner whatsoever.
Liability
The Company declines all liability for any damage resulting from the fraudulent
intrusion of a third party, beyond its control, which has led to the modification or
alteration of the information or Content appearing on the Site or has caused harm to any
User of the Site; and more generally for any damage, whatever its cause, origin, nature
or consequences, caused by anyone's access to the Site or by the impossibility of
accessing it, beyond its control.
The Company may under no circumstances be held liable for technical problems or
failures relating to telephone networks, online computer systems, servers, internet
service providers, or Users' computer equipment and/or software.
Links
Hypertext links established on the Site to other websites or to other internet
sources or content (the "External Sources") do not engage the liability of the
Company.
Insofar as the Company cannot control these External Sources, Users acknowledge that
the Company cannot be held liable for their availability, and bears no liability for the
content, advertising, products, services or any other material available on or from
these External Sources.
Governing law and jurisdiction
These Terms of Use are governed by and construed in accordance with French law,
without regard to conflict-of-law principles.
In the event of a dispute arising in connection with the interpretation and/or
performance of these Terms of Use, Users may choose to submit the dispute with the
Company to conventional mediation or to any other alternative dispute resolution

Users are informed that:
- for the dispute to be examined by the mediator, Users must show that they have
made a written complaint to the Company or its customer service department, and
must keep written proof of the steps taken; - the claim must be well-founded and legitimate.
Users may refer the matter to the mediator within a maximum period of one year
following their written complaint to the Company.
Finally, should this mediation procedure fail, or should Users wish to bring the
matter before a court, the rules of the French Code of Civil Procedure shall apply.
